Small Claims

All Small Claims actions in Alberta are heard in the Provincial Court - Civil Division. The current limit for claims is $7500 plus costs and interest. That does not mean that you can't file a claim with a higher limit only that you will have to give up any amount over this figure. The costs for a small claims action are considerably lower than if the case would be heard in the Court of Queen's Bench. You have the right under the Provincial Court Act to be represented by an agent.

Small Claims Court can not hear any case that involves the sale of land, charges against Peace Officers, actions where you seek damages under tort law, or where you are asking for an item to be returned to you.

We can prepare all the necessary documents and file them with the court to insure the greatest chance of success in your legal action. If you are being sued we can mount the best possible defence.

Small Claims court is designed to be an informal process with many of the normal courtroom rules not being applied. However, if you make a mistake in the filing procedure, or don't present your case correctly, you could still lose the case.
